Terms of Service

By using the Website and other services provided by MintedMarket, you are agreeing to all of the following terms and conditions.
1. Definitions
For the purpose of these Terms and Conditions, the following terms shall have the meanings specified below, unless otherwise indicated:

“Agreement” or “Terms and Conditions” shall refer to these terms and conditions that shall govern the relationship between MintedMarked Corp. and the Customer, except as otherwise specifically provided for, and as same may be amended from time to time, without notice;

“Bullion” shall refer to the term used to describe (1) Gold, Silver, Platinum, or Palladium Coin(s), bar(s), or round(s) which tend to follow spot prices and have little or no Numismatic value; and (2) the form in which metal is shaped such as bars, ingots, or wafers;

“Business Day” shall refer to the operational hours of MintedMarket, between 9:00 a.m. and 5:00 p.m. EST, Monday through Friday, excluding Saturdays, Sundays, and any statutory holidays and bank holidays in the province of Ontario;

“Coins” shall refer to a stamped piece of metal of a known weight and fineness issued by a sovereign government;

“Customer” shall refer to a Customer who enters into a transaction with MintedMarket Corp. for the purchase or sale of Precious Metal Bullion, and is in compliance with these Terms and Conditions between the Customer and MintedMarket Corp.;

Digital Gold” shall refer to a digital representation of Precious Metal;

Digital Gold Account” shall refer to an account which tracks the Customer’s purchases of Digital Gold. A Digital Gold Account is denominated in grams of gold.;


“Fair Market Value” shall refer to the Fair Market Value of the Product as determined by MintedMarket, at its sole discretion, on the date of cancellation of the Sales Order or the Purchase Order;

“Market Gain” shall refer to (a) When a Sales Order or Sale, is cancelled by MintedMarket, Market Gain occurs when the Fair Market Value of the Product(s) is greater on the date of the cancelled Sales Order or Sale than the original sales price of the Product(s) as it appears on the cancelled Sales Order; (b) When a Purchase Order or Purchase is cancelled by MintedMarket, Market Gain occurs when the Fair Market Value of the Product(s) is greater on the date of the cancelled Purchase Order or Purchase than the original purchase price of the Product(s) as it appears on the cancelled Purchase Order;

“Market Loss” shall refer to (a) When a Sales Order or Sale, is cancelled by MintedMarket, Market Loss occurs when the Fair Market Value of the Product(s) is less on the date of the cancelled Sales Order or Sale than the original sales price of the Product(s) as it appears on the cancelled Sales Order; (b) When a Purchase Order or Purchase is cancelled by MintedMarket, Market Loss occurs when the Fair Market Value of the Product(s) is less on the date of the cancelled Purchase Order or Purchase than the original purchase price of the Product(s) as it appears on the cancelled purchase order;

“MintedMarket” shall refer to MintedMarket Crop., an Ontario corporation;

“Numismatics” shall refer to a coin, of which the price tends to depend more on its (their) rarity, condition, dates, and mintmarks as opposed to their Precious Metal content, if any;

“Order(s)” shall refer to a confirmed Sale by a Customer or a confirmed Purchase by MintedMarket whether such Order was made by telephone, in person, through the Website, or otherwise;

“Product(s)” shall refer to a Product that is the subject of an Order. A Product may include, but is not limited to, Bullion, a coin, a Precious Metal, and/or supplies;

“Purchase(s)” shall refer to the acquisition of Product(s) by MintedMarket from a Customer, whether such Purchase was made by telephone, in person, through the Website, or otherwise;

Purchase Order(s)” shall refer to an Order placed by MintedMarket with a customer for the acquisition of Product(s) by MintedMarket from the Customer. 

“Sale(s)” shall refer to the acquisition of Product(s) by a Customer from MintedMarket, whether made by telephone, in person, through the website, or otherwise; 

“Sale(s) Order” shall refer to an Order placed by a Customer for acquisition of Product(s) by the Customer from MintedMarket; 

“User Content” shall refer to content posted by you on the Website, including without limitation any images or testimonials; 

“Website” shall refer to the websites located at www.MintedMarket.ca, www.shopmintedmarket.ca, and www.shopmintedmarket.com.
2. Buying from MintedMarket
2.1 Sales Order Confirmation

The price at which your Sales Order is submitted is considered to be the locked-in price. The Sales Order price is locked in for a period of five (5) Business Days. This is the time you have to make payment to MintedMarket. It is your responsibility to ensure that your payment is dated within 24 hours of your Sales Order confirmation and is received by MintedMarket within five (5) business days of your Sales Order confirmation. If payment is not received by MintedMarket within five (5) business days of your Sales Order confirmation, MintedMarket may choose to cancel your order at their sole discretion. 

2.2 Cancellations of Sales Order(s) by MintedMarket 

Once a Sales Order confirmation has been issued by MintedMarket a binding contract is created between the Customer and MintedMarket. You have no right to cancel your Sales Order(s). Your Sales Order(s) may only be cancelled at the sole discretion of MintedMarket if you default in your performance of payment, shipment, or any other act required by MintedMarket. MintedMarket reserves the right the cancel any Sales Order at any time and for any reason. Any Sales Order cancellations are subject our Market Loss Policy and a $25.00 CAD cancellation fee. Your Sales Order cancellation will be confirmed and at that time, if any Market Loss to MintedMarket has occurred, it will be calculated and added to the $25.00 CAD cancellation fee. If applicable, you agree you have full responsibility and liability to MintedMarket for any cancellation fee and/or Market Loss and you agree to remit immediately (upon notice) to MintedMarket good funds for any cancellation fee and/or Market Loss. No future Orders by you may be permitted unless and until any Market Loss is paid in full. Any Market Gain on Sales Order cancellations vests in and shall remain the property of MintedMarket. Upon written confirmation by MintedMarket of your payment of the $25.00 CAD cancellation fee and/or Market Loss, we will forgive further action against you and your responsibility for any breach by you and all resulting damages owed to MintedMarket.

2.3 Changes to Sales Order(s) 

Once a Sales Order confirmation has been issued by MintedMarket the Sales Order can only be changed at MintedMarket’s sole discretion. 

2.4 Sales Order Payment Requirements 

When you place an order with MintedMarket it is your responsibility to ensure we receive your payment within five (5) business days from the date your Sales Order is placed. If we do not receive your payment within five (5) business days from the date of your Sales Order, MintedMarket may at its sole discretion (i) accept your payment; (ii) refuse your payment and cancel your Sales Order; (iii) close your account; and/or (iv) prohibit you from placing future Sales Orders and/or Purchase Orders with MintedMarket. If your payment is not received by MintedMarket within five (5) business days, you will be liable for any Market Loss as outlined by our Market Loss Policy. You agree you have full responsibility and liability to MintedMarket for any cancellation fee and/or Market Loss. Any Market Gain vests in and shall remain the property of MintedMarket. 

2.5 Making Payment 

MintedMarket reserves the right to refuse or cancel any Sales Order at any time, including if it is deemed to be questionable or of risk to MintedMarket regardless of payment method, price confirmation, or Sales Order confirmation. In such case, you waive the right to any claim or actual damages of any kind or nature whatsoever. 

2.6 Hold Period on Cheques 

All Sales Orders paid for by cheque, draft, or money order are subject to a hold period between 5-10 business days. This hold period may be extended at the sole discretion of MintedMarket. The hold period applies regardless of whether such cheques, drafts, or money orders clear the banking system.
3. Shipment of Orders
3.1 Insured Shipping for Sales Orders

MintedMarket insures all Sales Orders while in transit for the sale value of the enclosed Product purchased from MintedMarket, subject to the following limitations. It is your responsibility to notify us of your lost package within ten (10) business days from the ship date of your order. Should anything happen to your package while it is in transit to you, you might be permitted to claim coverage under our insurance policy provided that you directly receive the package from the common carrier. Neither we, nor our insurance company accepts (and we specifically disclaim) responsibility if you have left instructions with any carrier or delivery service to leave parcels for you without the need for your signature. It is your responsibility to ensure you are present to sign for your package. Neither we, nor our insurance company accept responsibility if you do not sign for your package yourself. If you do not receive the package directly from the common carrier, you agree to take all reasonable actions to assist in the recovery of the package, including but not limited to filing our reports, policy reports, and providing all information needed or requested to assist in the recovery of the package. If you do not fully cooperate in recovery efforts, neither MintedMarket, nor our insurance company or carrier will have any liability to you. When MintedMarket ships to you, if we determine the package is lost or damaged, we file a claim. Once a claim is filed, we reserve the right to re-ship your items or refund your money at our discretion and MintedMarket shall have no further responsibility or liability to you. You agree to cooperate with us in any investigation or claim process and to take every reasonable action requested of you. If you do not fully cooperate, neither MintedMarket, nor our insurance company or carrier will have any liability to you.

3.2 Back Ordered Items 

Occasionally, even if our Website shows an item to be in stock, we reserve the right to delay the delivery of your Sales Order for up to 28 calendar days. This may be due to supply and demand issues. Provided that you have not defaulted in any term of your completed transaction, even if the price of the Product were to rise, your price is locked in. We will attempt to acquire and ship your Product(s) within 28 calendar days. If we are sold out of your item and/or cannot ship your Product(s) within 28 calendar days, we will refund your original sales price. If a refund is provided, or there is any delay in shipping your Products, you waive the right to any claim or actual damages of any kind or nature whatsoever.

3.3 Undeliverable Items

In the event that an order is undeliverable to the designated address and is subsequently returned to the sender, the customer has the option to request a reshipment of the item at their own expense or opt for a refund. These options must be claimed within 30 days from the date of the initial delivery attempt. Any requests made beyond this timeframe may not be guaranteed. MintedMarket may, at their sole discretion, pay for the reshipment of the item.
4. Return Policy
At your request, we may, but are not obligated to, provide you with an opportunity to exchange a Product for an identical Product in the event of a material defect. If we agree to do so, such exchange must be made within seven (7) calendar days from the date on which the Customer receives their Product(s) and only to those Customers who timely and properly notify our Customer Service Department by telephone or email, and who receive written confirmation that the exchange request has been approved. If approved, the Customer Service Department will provide instructions on the how to exchange said items.

Shipping and handling charges are non-refundable. For approved exchanges as described above, you must follow all instructions provided by Customer Service. You are responsible for carefully packaging the Product and are responsible for the cost of return shipping and the risk of loss during the return shipment as part of the exchange. MintedMarket reserves the right, at its sole discretion, to reject any exchange that does not comply with these requirements. If an exchange is requested, we reserve the right to accept or refuse the exchange request at our sole discretion and require you to pay any Market Loss on approved exchanges. Any Market Gain on refunds shall vest in and remain the property of MintedMarket.
5. Selling to MintedMarket
5.1 Minimum Transaction Size for Purchase Order

When you sell your items to us, our minimum Purchase Order amount is $700 CAD.

5.2 Delivery Terms for Purchase Orders 

 Once your Purchase Order has been confirmed by MintedMarket, you may not cancel and are obliged to send the agreed upon quality and quantity of Precious Metals to MintedMarket. After confirmation, your Purchase transaction to MintedMarket may be cancelled at the sole discretion of MintedMarket if you are in default in the performance of any of these requirements: (i) we do not receive the Precious Metals which are part of such Purchase Order to us within 5 Business Days of issuing the Purchase Order confirmation; (ii) you do not inform us with the registered mail or tracking number of your parcel within 24 hours of issuing the Purchase Order confirmation; and/or (iv) Precious Metals are received but do not meet the quality standards, agreed quantity. If your Purchase Order transaction obligation(s) are not met and/or your purchase Order transaction is cancelled by MintedMarket, you agree that you are responsible for and liable to cover any Market Loss we may or do incur by accepting the Purchase Order to buy from you. This is covered in our Market Loss Policy. Furthermore, at our sole discretion, you may not be permitted to buy from us to sell to us in the future. If you inform us with the registered mail or tracking number as required and we do not receive the item(s) within 5 business days of issuing the Purchase Order confirmation and the delay is due to the carrier, we may, but are not obliged to, extend the deadline on a case-by-case basis and at our sole discretion. We reserve the right to cancel any Purchase Order at any time and for any reason. All risk of loss in any Purchase Order is borne by you until MintedMarket takes actual physical custody and control of each and all of the Product(s) that are the subject of the Purchase Order. 

5.3 MintedMarket’s Payments to You for Purchase Orders 

When we receive the package containing your Purchase Order items and after we have confirmed the quality, quantity, and otherwise the entire accuracy of the transaction, we will typically send out the payment due within 3-5 Business Days in one of the following ways. You can select the payment method as described blow that best suits your needs. Depending on the value of the Purchase Order, you may choose to be paid either by (i) Cheque; (ii) Bank Wire; (iii) e-Transfer; (iv) Direct Deposit. 

5.4 Cancellation of Purchase Orders 

Once a Purchase Order confirmation has been issued by MintedMarket (i) all prices are lock-in, and (ii) there is a binding contract between us for your transaction and, as a result, any market risk for breach is transferred to you at the time the Purchase Order is confirmed. You have no right to cancel Purchase Order(s). If you default in your performance of shipment, quality, quantity, or any other act required to complete the Purchase Order transaction as required, we may cancel your Purchase Order(s). We reserve the right to cancel any Purchase Order at any time and for any reason. All Purchase Order cancellations are subject to our Market Loss Policy plus a $25 CAD cancellation fee. If any Market Loss to MintedMarket has occurred at the time of the cancellation, it will be calculated and added to the $25 CAD cancellation fee. If applicable, you agree you have full responsibility and liability to MintedMarket for any cancellation fee and/or Market Loss ad you agree to remit immediately to MintedMarket good funds for any cancellation fee and/or Market Loss. No future Orders may be permitted until any Market Loss is paid in full. Any Market Gain on Purchase Order cancellations vests in and shall remain the property of MintedMarket, and MintedMarket shall have no responsibility to you for Market Gain. Upon written confirmation by MintedMarket of your payment of the $25 CAD cancellation fee p.us the Market Loss, we will forgive further action against you and your responsibility for any breach by you and all resulting damages owed to MintedMarket.
6. Market Loss Policy
When you buy from MintedMarket and we have issued a Sales Order confirmation number, you have a binding contract. The transaction price is locked in, and any corresponding market risk is transferred to you. If you default in your performance of payment, shipment, or any other act required by you, we may cancel your Sales Order(s). If your Sales Order(s) is cancelled, you agree you have full responsibility and liability to MintedMarket for any Market Loss, plus a $25 CAD cancellation fee. You must also pay and have full responsibility and liability to MintedMarket for all fees and costs associated with MintedMarket’s efforts in collecting from you. Any Market Gain on Sales Order cancellations shall vest in and remain the property of MintedMarket, and MintedMarket shall have no responsibility to you on Market Gain. We reserve the right to cancel any Sales Order at any time and for any reason. All future Sales Orders will be held for shipment until any/all outstanding Market Loss and/or cancellation fee balances have been paid in full.

When you sell to MintedMarket and we have issued a Purchase Order confirmation number, you have a biding contract. The transaction price is locked in, and any corresponding market risk is transferred to you. If you default in your performance of payment, shipment, or any other act required by you, we may cancel your Purchase Order(s). If your Purchase Order(s) is cancelled, you agree you have full responsibility and liability to MintedMarket for any Market Loss plus a $25 CAD cancellation fee. You must also pay and have full responsibility to MintedMarket for all fees and costs associated with MintedMarket’s efforts in collecting from you. Any Market Gain on Purchase Order cancellations shall vest in and remain the property of MintedMarket, and MintedMarket shall have no responsibility to you for Market Gain. We reserve the right to cancel any Purchase Order at any time and for any reason.

7. Binding Contract
Once you have placed a Sales Order to buy from MintedMarket or a Purchase Order to sell to MintedMarket you have entered into a legal binding contract.

8. General Provisions
8.1 Absence of Relationship

The sole relationship between MintedMarket and you is that of a buyer-seller. No other relationship between you and MintedMarket exists.

8.2 Additional Terms

Additional terms relating to certain Products (such as prices, methods of payment, our policies with respect to returns, refunds, and cancellations and/or exchanges) may be posted on the site on the pages describing the Products.

8.3 Force Majeure

If MintedMarket cannot perform any obligation hereunder as a result of any event that is beyond its control, MintedMarket delay or failure to perform such obligation shall be excused and MintedMarket shall not be liable for any damages as a result of, or in connection with, such delay or such failure.

8.4 Pricing or Typographical Errors

We work hard to provide accurate Product and pricing information to you. However, pricing or typographical errors may occur. In the event that an item is listed at an incorrect list price or with incorrect information due to an error in pricing or Product information, MintedMarket shall have the right, at our sole discretion, to refuse or cancel any Sales Orders or Purchase Orders placed by or sent to you for that item. We will either contact you for instructions or cancel your Sales Order or Purchase Order and notify you of such cancellation. Prices and availability are subject to change without notice. If a refund is provided or there is any delay in sending you your Products or your payment, as the case may be, you waive any right to any claim or actual damages of any kind or nature whatsoever.

8.4 Section Headings

The section headings are included for ease of reference and do not affect the interpretation or the scope of the User Agreement.

8.5 Severability

The User Agreement is intended to be enforceable to the fullest extent permitted by applicable law. If any term of the User Agreement is held to be unenforceable for any reason, such unenforceability shall not affect the other terms of the User Agreement, and the term that would otherwise be unenforceable shall be enforced to the fullest extent that it would be enforceable.

8.6 Amendment

MintedMarket may amend the User Agreement at any time by posting the amended terms on the Website and such amendments shall become effective immediately.

8.7 Terms of Use

This website is owned and operated by MintedMarket. Access and use of this website is provided by MintedMarket to you on condition that you accept these Terms of Use, and by accessing or using this website, you agree to these Terms of Use. If you do not agree to accept and abide by these Terms of Use you should not access or use this website. MintedMarket may revise and update these Terms of Use at any time and without notice. You are cautioned to review the Terms of Use posted on the website periodically. Your continued access or use of this website after any such changes are posted will constitute your acceptance of these changes.

9. Digital Gold Accounts
9.1 Opening a Digital Gold

Account By signing up for an account with MintedMarket on the website, a digital gold account is automatically opened for you. You may contribute to your digital gold account at anytime by purchasing digital gold on the website. 

9.2 Purchasing Digital Gold

You may contribute to your digital gold account at anytime by purchasing digital gold on the website. The minimum transaction amount is 1 gram of Digital Gold.

9.3 Redeeming Digital Gold for Physical Gold

You may choose to redeem an equivalent amount of Digital Gold for Physical Gold. For example, if you have five (5) grams of Digital Gold, you may redeem for a five (5) gram gold bar or five (5) individual one (1) gram gold bars. Converting Digital Gold to Physical Gold comes at a fee known as a Bar Charge. The Bar Charge varies depending on the Physical Gold product you would like to obtain. MintedMarket does not guarantee the availability of Physical Gold for the redemption of Digital Gold. The deposits in a Digital Gold account are not backed by Physical Gold. 

9.4 Selling your Digital Gold 

MintedMarket may, but is not obliged to, purchase the Digital Gold in your account. MintedMarket will determine the value of the Digital Gold in you Digital Gold Account based on the market value of Gold at that time. MintedMarket may charge a fee for providing this service to you. 

9.4 Additional Details 

• MintedMarket reserves the right to close your Digital Gold Account at any time in MintedMarket’s sole discretion. 

• Balances in your Digital Gold Account will not earn interest.
